About this course

Increasingly, issues considered in a workplace investigation may end up in arbitration for review. In their subsequent decisions, arbitrators have shed interesting light on what investigators ought to include as part of the investigation process, as well as mistakes to avoid.

Join Janice Rubin and two highly respected arbitrators, John Stout and Christopher Sullivan, who will discuss with us two of their recent cases that deal with workplace investigations: Toronto District School Board v. Canadian Union of Public Employees, Local 4400, 2021 CanLII 101010 (ON LA), and BC Public School Employers Association / A Certain School District v. BC Teachers’ Federation/ A Certain Teachers’ Association, 2022 CanLII 60950 (BC LA).

John Stout is a mediator and arbitrator, practicing primarily in Ontario in both the private and public sectors. He has over twenty-five years of labour relations experience, the last 14 as a neutral. Arbitrator Stout is on the Ontario Ministry of Labour’s list of approved grievance arbitrators and is an approved adjudicator under the Canada Labour Code. Arbitrator Stout is named as Chief Arbitrator and a roster arbitrator in numerous collective agreements. He is also a member of both the National Academy of Arbitrators and the Ontario Labour Management Arbitrators’ Association.

Christopher Sullivan is a third-party neutral arbitrator, mediator, umpire, troubleshooter, and investigator. He has over twenty years’ experience mediating, adjudicating, and investigating disputes. Arbitrator Sullivan is a named neutral in many negotiated industry lists in the private and public sectors. He is on the British Columbia Labour Relations Board's Register of Arbitrators, and is a member of both the Arbitrators Association of BC and the National Academy of Arbitrators.
